2. Eligible Buyers
EKO Labs USA supplies only to:
- Verified professional accounts approved by EKO Labs USA’s compliance team;
- Authorized partners under a current Authorized Partnership Program contract.
3. Order Acceptance
Orders are accepted at the sole discretion of EKO Labs USA. We may decline or modify any order based on credential status, jurisdiction, quantity, or compliance concerns.
4. Pricing
Pricing is provided only to verified accounts and is subject to change without notice. Wholesale tier pricing is assigned at application review under the
Authorized Partnership Program.
5. Payment Terms
Payment terms are set during account onboarding. Standard accounts pay at the time of order. Authorized partners may have negotiated terms specified in their contract pack.
6. Delivery
Delivery occurs under the
Shipping Policy. Title and risk of loss pass to the buyer at the time of carrier pickup unless otherwise specified in a contract addendum.
7. Product Specifications
Every shipment is accompanied by Certificate of Analysis (COA) documentation describing batch identity, purity, and applicable specifications. Buyers are responsible for confirming receipt and storage in accordance with the COA.
8. Intended-Use Compliance
Buyers agree at the time of order to use products only as set out in the
Intended Use Policy. Misrepresentation of intended use is grounds for immediate account termination.

EKO Labs USA is not liable for delays or non-performance caused by events outside our reasonable control, including supply-chain disruptions, regulatory changes, and natural events.
11. Governing Law and Disputes
These Supply Terms are governed by the laws of the State of Delaware, United States. Any dispute will be resolved in Delaware state or federal courts. The parties may agree to arbitration in writing in lieu of litigation.
